In the aftermath of the DePuy and Tylenol debacles, Johnson & Johnson CEO Weldon says: “We’ve learned our lesson”. Have they?

Posted by - April 29th, 2011

In an AP interview with J&J head honcho William Weldon prior to his upcoming presentation to investors at the his shareholders’ meeting, the CEO of one of America’s most storied companies defended his company’s honor, holding the line that the problems caused by the many, many recalls of its products are mostly behind them.  The myriad of problems were well chronicled in this month’s excellent BusinessWeek article, aptly titled "Johnson & Johnson’s Quality Catastrophe".  All told, the documented recalls and problematic devices, drugs, and children’s medicines have affected the lives of thousands.  These problems range from a smelly jar of kid’s medicines to life-destroying crippling of active seniors.  Specifically, these recalls include:

  • DePuy ASR and ASR-XL Systems: J&J’s (through it’s DePuy subsidiary) metal-on-metal hip implant lines ASR and ASR-XL are just the most recent (and possibly most devastating) recall to affect the Johnson & Johnson legacy.  Defective hips were inserted into possibly tens of thousands of Americans — many after J&J had already been forced to halt using these devices in other countries due to serious safety concerns.  So while J&J were forced to act responsibly in other countries, Americans continued to get the faulty hip systems. Estimates put the potential early failure rate of these hip replacement models at almost 50%.  To further complicate matters, studies suggest that a likely cause of these failures is that the metal-on-metal device rubs the wrong way, resulting in metal shavings entering the bloodstream.  These metals, which include carcinogenic cobalt and chromium, threaten ASR and ASR-XL recipients with metallosis, cobalt poisoning, chromium poisoning, and even cancer.  Learn more about DePuy ASR and ASR-XL lawsuits here.
  • Levaquin: J&J’s (through its subsidiary Ortho-McNeil) blockbuster antibiotic Levaquin is at the center of thousands of lawsuits.  The drug, which is a very strong and very effective antibiotic, has been increasingly used as a "first-defense" medication, when other antibiotics would have sufficed.  This meant two things:  First, the drug would put plus per pill into J&J’s coffers (versus the fraction that other antibiotics — which are generic — would cost).  Second, it put these consumers at risk of Levaquin’s very real side effects.  Tens of thousands of consumers have reported that they had developed tendonitis, torn ligament, or ruptured tendons.  This effect is most severe in people over 60 years old and people concurrently taking steroids.  Ortho-McNeil did its best to downplay this relationship, butlost big in the first of thousands of Levaquin lawsuits to go to trial.
  • Motrin: In an almost farcical scene out of a movie, in 2008 J&J sent its employees and contractors out to retain stores to buy up all the Motrin it could get their hands on.  They began removing defective supplies of the popular painkiller from store shelves in an effort to do a stealth recall.  Months later, the company nonetheless decided to let the public in on these problems and issued a public recall.
  • Tylenol: Ortho-McNeil recalled about 6.3 million bottles of tainted Tylenol Arthritis Pain caplets in November 2009.  These were manufactured in its plant in its troublesome Puerto Rico.  The tainted drugs had a pungent odor, which was later attributed to chemicals used to treat wood.  This plant now remains closed until it can pass regulatory muster.
  • Recall Mania!: In just this past fiscal quarter alone, J&J withdrew over half a million surgical sutures due to concerns about compromised sterile packaging, (through its Animas subsidiary) recalled 384,000 insulin-pump cartridges that may leak, and recalled 70,000 potentially cracked syringes preloaded with the antipsychotic Invega, and withdrew 43 million bottles of Rolaids, Tylenol, Benadryl, and Sinutab.

So, now Johnson & Johnson says their problems are behind them.  We hope so.  They have shuffled management and issued new safety guidelines.  But with Billion in cash, J&J undoubtedly has the power to withstand any nuisances that these recalls and lawsuits may cause their balance sheets

.  William Weldon still has his job.  Maybe one of these recalls has finally got his attention, and that they put product safety on par with corporate profits.

On April 27, 2011, Johnson & Johnson announced its purchase of Synthes, a medical-device maker for a reported Billion.  The deal will leave J&J controlling over 50% of the global market for products used in treating traumatic injury (such as discs, screws and rods to piece together broken bones).  The new J&J would then be twice the size of its nearest competitor in these orthopaedic implants.  We hope they’re more careful with their new products.

If you or a loved one has been affected by a DePuy ASR or ASR-XL recall or one of the other recalled J&J products and would like to learn more about your legal rights, contact the lawyers at Slater, Slater, Rosenberger & Schulman, P.C. at 1-800-251-6990 or www.srslawfirm.com for a free case evaluation today.  Slater, Slater, Rosenberger & Schulman, P.C., with offices in New York and Melville, Long Island, is a full service law firm dedicated to representing clients across the country in prodcuts liability, pharmaceutical and other litigation.

To Be A Kid Again With Your 12 Year Old Granddaughter

Posted by - April 21st, 2011

DSC00671Last weekend our 12 year old granddaughter, Tatum, came to visit for a couple of days from Kansas City. Prior to her visit I wasn’t quite sure what we would do that would be a memorable time. She doesn’t get to visit very often so I wanted it to be special.  The first day we took advantage of a groupon offer I had purchased to go bowling at the Fountain Hill bowling alley, I love all these new sites like Groupon, Deal Chicken and Living Social that give these great half off deals. Total bargains.

The bowling was fun, it had been years since Howard and I had bowled. Seemingly it did not seem to make a difference to Howard who managed to “bowl us over”, get it “bowl” with a 158 for his first line. I won’t bother telling you my scores, but might I just say it reflected my long absence from a bowling alley. Looking back I think the bowling was more memorable for Howard than for Tatum or I.Howard Bowling

That evening we drove out to the Fort McDowell Indian Reservation for the Friday Night Franks dinner I had heard about. Within minutes of our arrival I knew that this special event that I had planned for the three of us was going to be memorable and it was. . . but for all the wrong reasons.

Here I was expecting this great Arizona western cookout experience. You know cowboy songs, a campfire where you sit around and listen to cowboy stories, hay rides and smores. Much to my disappointment were a bunch of 6 yearolds doing the birthday party thing, a tour group in very non western attire, and an invitation to join a 100 yard walk in the desert where we listened to a guide telling us about the medicinal uses of the creosite bush. So far this is not going the way I envisioned.

To make matters even worse, we were given a meatless mealy hot dog in a plastic bag, a cold hot dog bun with no slit to put the hot dog in the bun, a bag of potato chips, a bag with two stale marshmallows and stale graham crackers all neatly placed in one of those thin cardboard containers that they put french fries in at the In and Out Burger. Time to leave was clearly written on all of our faces.

Wild Horses Ft. McDowell Indian ReservationAfter such a let down we headed back on the two mile dirt road that we had traveled earlier. Much to our surprise, some 20 yards in front of us,  appeared the most beautiful band of wild horses. THANK YOU GOD  immediately penetrated my thoughts. This was truly a  memorable moment for all of us to see these beautiful creatures in such a natural setting.

So one day down and one day left to create this memorable 2 day trip for Tatum. I know, let’s go to the  Body World exhibit at the Science Center. You know the one where they freeze dry dead people and you get to look at slices of their brain. Tatum’s response to what I thought was a great idea was a simple “CREEPY”. Well after umpteen suggestions, that only generated untolled rolling eyes, at last it came to me. What about Wet N Wild? OMG  jackpot! I thought Tatum’s eyes were going to pop out of her head.

After entering the park and feeling really good about the day ahead of us I splurged for our own private cabana. Home Run, Tatum loved the idea. Lounge chairs, a TV, awesome and right in front of the Wave Pool. That would be my thing while Tatum could explore the very high and crazy tubular attractions throughout the park that I had no intention of going on. After two back surgeries in years past the wave pool would work out just fine.

Tornado ride Wet'n'WildHmmm, fine memorable experience this would be, Tatum doing the water attractions by herself. Don’t ask me how or why but somewhere my brain left my head when Tatum said are you ready Grandma Teej. Lets go on the Tornado. At that moment I knew there was no way I could mouth the words, I’m sorry honey but . .

What I did know was that when I started to climb those Tornado steps, as I did when we went from one attraction to the next, I knew I was the oldest person going up those steps. I knew I was absolutely nuts, and scared shitless, but for a moment I felt like I was 12 years old again. I had a ball.  More importantly I also knew that I had created a memorable time for my grand- daughter. It certainly is something I will always remember.

Lead Paint Poisoning

Posted by - April 20th, 2011

http://www.youtube.com/watch?v=-fxeu3xvY34

If your home was built before about 1977, then there could be a serious health hazard sitting in plain sight.  In the past, lead paint was used in homes, schools, and even hospitals. In the 1970s, lead paint was outlawed after researchers discovered that lead paint was making home owners very sick.

Over the last few decades, most homes have been renovated and repainted, but thousands of older homes still contain the original lead paint. To learn more about lead paint hazards, watch this video.

If you think you have become sick due to lead paint poisoning, then you might want to consider hiring a personal injury lawyer to help you fight for medical compensation.  At Slater, Slater, Rosenberger & Schulman, P.C., we can help you! Call us at 1-877-8591 or visit our website to learn more.

Lakeside Resort Casitas In Fountain Hills . . Location and Size Couldn’t Be More Perfect

Posted by - April 19th, 2011

Lakeside Resort Castitas in Fountain Hills AZThe Lakeside Resort Casitas are one of my favorite condominium developments in Fountain Hills. They don’t have the typical apartment style condominium feel that you see everywhere. They really have that southwest “casita style charm” about them and their location could not be more perfect since they are located right across the street from  Fountain Park.  These units are great for second home owners that don’t need a ton of space, want all the amenities of a resort, but want to own their own place. In addition to Fountain Park you are within walking distance of Plaza El Lago with a couple of great local restaurants, shops, a wine bar and coffee house.

The casitas were built in 1986-1988 and range in size from 649 SF to 864 SF. They are all single level, one and two bedroom configurations and they all have fireplaces. There are a few first level units that do not have anyone above adding to the appeal for those that don’t want a second floor unit. As a second home owner you will enjoy using your unit for yourself,  but they are also very popular for vacation renters during our January through May high season.

Click here to view the embedded video.

Some of the amenities that the Lakeside Resort Casitas offer are a good size resort style heated salt water pool and spa center, two ramadas and a clubhouse.  The HOA fees are 5 a month and includes exterior maintenance of the units, roof replacement, blanket insurance policy, garbage collection, cable or satellite TV, front yard maintenance and common area maintenance.

There are a few of these great casitas on the market as I write this blog and of course I would be happy to send you more information or add you to my list of other clients that have requested to receive new listings as they come on the market in the Lakeside Casitas Resort  neighborhood.

Roof Leak Revealed on Charlotte Home Inspection

Posted by - April 18th, 2011

During a home inspection in the Myers Park section of Charlotte NC, home inspector Cliff Crow found an active roof leak.  Cliff said that his first clue was the cool whip can placed in the attic.  Sure enough directly above the the cool whip container was an active leak.  Cliff would have found the roof leak either way but whenever there is something in the attic to catch the water it is pretty obvious that there is a leak.

The Facts: Patient Safety in Hospitals

Posted by - April 16th, 2011

In 1999, a landmark study was conducted by the Institute of Medicine to find out how many mistakes were made in hospitals around the United States. The study found that medical mistakes accounted for nearly 98,000 deaths per year and over a million injuries.

A lawyer can help you fight for compensation if you were injured by a medical mistake, but it’s better to try and avoid the issue in the first place.  Here are some common mistakes to watch out for if you or a loved one has to visit the hospital.

  • Unclean Instruments

Always ask to make sure all of the equipment in your room has been properly sterilized. Infections are common in hospitals due to unsterilized equipment and germs that float through the air.

  • Distracted Staff

If your nurse seems too busy to fully concentrate on your needs, then make sure you get a second opinion. You could also ask him or her to return to your needs once they have more time to properly assess your medical condition.

  • Wrong Medication

Make sure you bring a list of your medical allergies, and ask the doctor to double check any medication before you are given a dose.

Unfortunately, overcrowded hospitals and overactive medical staff make it difficult to guarantee a patient’s safety in a hospital. If you have been injured in a hospital, then call a medical malpractice lawyer in Melville, NY. Similar to a personal injury lawyer, medical malpractice lawyers specialize in proving that neglectful actions took place and resulted in an injury in a medical setting.

Slater, Slater, Rosenberger & Schulman, P.C. is here to make sure you get the compensation you deserve if you are injured in a medical setting. If you’re not located near NYC or Long Island, then our personal injury attorneys will fly across the country to ensure your case receives the proper attention.
